Payment for Written Advice on Appeal

For the avoidance of doubt, the following applies when counsel advises in writing on appeal against conviction or sentence in a VHCC:

If counsel advises against appeal, then - subject to agreement as to hours etc - the advice will be paid by the Complex Cases Unit under the contract.
If counsel advises in favour of appeal, then the Registrar of Criminal Appeals will pay him/her for the advice and grounds of appeal, provided a Form NG has been lodged and irrespective of whether the single judge grants or refuses leave, or refers the application to the full Court.
