Wasted Cost Orders

The Courts and Legal Services Act 1990 makes provision under Sections 4 and 111 for a court to make a Wasted Costs Order in civil or criminal proceedings against the barrister or solicitor.  A Guidance Note on Wasted Costs Orders has been produced by the Professional Standards Committee.

The Legal Services Committee of the Bar Council also has a small panel of barristers who are ready to offer assistance, advice and representation where proper to any barrister under threat of such an Order. The panel consists of civil and criminal practitioners with representatives from the Circuits and London.
