 Excess Professional Indemnity Insurance

Aggregate or Any One Claim.

The Bar Mutual Indemnity Fund (BMIF) rules changed on 1 April 2006. BMIF now regard as one claim, claims arising from;

(a) the same act or omission; or
(b) a series or group of related acts or omissions; or
(c) a series or group of similar acts or omissions; or
(d) the same originating cause,

It is therefore essential, to ensure that your excess layer cover is sufficient to meet claims, that might be subject to aggregation in light of this.

Claims Made Cover.

We have also noticed, that in some cases, the Limit of Cover that a barrister chooses to purchase in excess of the BMIF fluctuates significantly from one year to the next. A possible reason is that a barrister considers the Limit of Cover required, based on current work. It should be remembered however, that cover operates on a ‘claims made’ basis and as such it is the policy (or Limit of Cover) in force at the time a claim is made that will respond and not the policy (or Limit of Cover) in force when the work was undertaken.
