Distress is not the same as stress. It alters neurobiology in ways that directly affect the core functions legal practice depends on: memory, communication, reasoning, chronology and decision-making. These shifts are not about a lack of competence. They are biological responses to pressure.
Knowing how to recognise and navigate these shifts matters - for our clients, witnesses and ourselves as practitioners. In fact, it is central to ethical and effective practice.
This training addresses a critical gap in legal education: the difference between how we assume people function and how they actually function under pressure - including when distress, overwhelm and trauma are present. It introduces practical, trauma-informed techniques to support more effective advocacy, clearer communication and more sustainable practice.

Distress, overwhelm and trauma are not confined to any one field. They can arise wherever legal processes intersect with human experience and heightened emotions - from criminal and family work to commercial disputes, regulatory investigations and workplace conflicts.
And it’s not just about our clients and witnesses. As barristers, we each bring our own experiences and histories to the work. These personal stories can shape how we respond to pressure, distressing material, and client dynamics. It’s easy to underestimate the impact of our own nervous system responses or vicarious exposure to others’ trauma. This training supports you to notice and navigate these dynamics effectively.
Whether you are at the start of your career or an experienced practitioner, this session provides practical insight and tools to support both professional effectiveness and long-term sustainability.
What will I learn?
Drawing on neuroscience, psychology and practice-based experience, this session provides practical tools that can be applied immediately within legal work. The session is interactive, educational and experiential, incorporating discussion, reflection and practical exercises.
The training includes:
- Neurobiology of stress vs. distress: An overview of how the impact of distress, overwhelm and trauma differs from stress, with a focus on the brain and nervous system, together with strategies for self-regulation, designed to enable you to stay calm and skilled.
- Understanding the impact of distress, overwhelm and trauma on memory and cognitive impairment: We explore the latest neuroscience in relation to the implications on memory, language, emotional regulation and decision-making.
- Recognising indicators of distress, overwhelm and trauma: How to identify potential signs of distress, overwhelm and trauma in clients, witnesses, colleagues and yourself, even when those signs might be subtle or disguised.
- Understanding vicarious trauma and cumulative impact: Understanding the impact of repeated exposure to distressing material, chronic stress and continuous pressure in high-stakes environments.
- An introduction to trauma-informed communication: Practical techniques to support clearer, safer and more effective engagement in challenging moments or when navigating unexpected responses.
- Real-life examples throughout: Scenarios illustrating the relevance of this learning across different areas of practice, including situations that do not appear to be explicitly distressing or traumatic.
- Integrative self-care techniques: Practical tools designed specifically for the busy barrister. This includes practical ways to check in and navigate the impact of stress and trauma exposure, with strategies to reduce the risk of burnout.
- Support, boundaries and signposting: Understanding the importance of attuned support in the immediate aftermath of distress, including exploring when additional support is needed and how to respond appropriately within your role.
