Mediation Documents Seminar 2017

The aim of this training session is to help members of the Bar acquire and improve their skills as advocates representing parties in mediation.

It will focus on the documents barristers are likely to encounter in a mediation, and what documents they should ideally prepare in order to represent a client effectively in mediation.

Documents to be considered and discussed will include:

  • Mediation agreement, to include consideration of possible terms concerning the status of documents produced for the mediation which might be included in the agreement, and the remedies for breach of the agreement.

  • Mediator's terms and conditions. Any particular terms and conditions of which the barrister advocate should beware.

  • Open position statement prepared on behalf of the lay client. What should it ideally contain? How bold should the barrister be in that statement? Is it wise to set out a settlement offer in that statement?

  • Case summarylist of issuesschedule of financial claimcosts schedule or budget, or any legal, expert or evidential analysis.

  • Draft settlement agreements, or draft clauses of a potential settlement agreement that a barrister may wish to prepare in advance of the mediation.

  • Any other documents prepared on behalf of the lay client to be submitted to the mediator in confidence.

The cost of attending the seminar are

  • £30 + VAT for chambers' staff and barristers who paid the Bar Representation Fee

  • £45 + VAT for barristers who have not paid the Bar Representation Fee
